1. INTRODUCTION

Welcome to Starry Ferry Books' Embark Membership and Reward Program (the "Program"). By participating in the Program, you agree to comply with these Terms and Conditions. Please carefully read and understand the provisions outlined herein.

2. MEMBERSHIP ELIGIBILITY

The Program is open to legal residents of the United States, with a valid United States address, who have reached the age of majority in their respective province or territory of residence. Starry Ferry Books reserves the right to request proof of age at any time.

• Applicants must be legal residents of the United States.
• Applicants must maintain a valid United States address for membership purposes.

2.2 Age Requirement:

• Applicants must have reached the age of majority in their respective province or territory of residence.
• Starry Ferry Books reserves the right to request proof of age at any time.

2.3 Membership Fee (Embark+ Only):

• To apply for Embark+ membership, individuals must pay the annual membership fee of $39.

3. MEMBERSHIP TIERS

The Program offers two distinct membership tiers, each with its own set of benefits:

3.1 Embark (Free Membership):

• Complimentary Shipping: Free shipping is provided for eligible print media purchases exceeding $65. Print media is defined as books and related publications in physical, printed formats (excluding audiobooks).
• Reward Points: Members earn 1 point for every dollar spent on eligible purchases (excluding audiobooks).
• Early Access: Members enjoy early access to promotions and exclusive events.

3.2 Embark+ ($39/year Membership):

• All Embark Membership Benefits: In addition to the benefits outlined in Section 3.1, Embark+ members enjoy all the advantages of Embark membership.
• Enhanced Discount: Embark+ members receive an extra 10% discount on nearly all products.
• Unrestricted Shipping: Free shipping on all eligible print media products is provided, with no minimum purchase requirement (excluding audiobooks).
• Reward Points Acceleration: Members earn 2 points for every dollar spent on eligible purchases (excluding audiobooks).
• Welcome Offer: Upon joining Embark+, members are eligible to earn 1,200 bonus Embark points ($20 value) for utilization within the first month of membership.

4. MEMBERSHIP ACCEPTANCE

Participation in the Program is open to individuals who meet the eligibility criteria specified above. Starry Ferry Books reserves the right to approve or reject membership applications at its discretion.

5. POINT ACCUMULATION AND USAGE

5.1 Point Accumulation:

• Members accumulate points based on eligible purchases as outlined in Section 3.
• Starry Ferry Books may offer special promotions that allow members to earn additional bonus points, subject to specific terms and conditions.

5.2 Point Usage:

• Points can be redeemed for rewards and benefits as outlined in the Program.
• Starry Ferry Books reserves the right to establish the point redemption schedule, which may be subject to change.

6. MEMBERSHIP TERMINATION

6.1 Termination by Member:

• Members may terminate their membership at any time by contacting Starry Ferry Books.

6.2 Termination by Starry Ferry Books:

• Starry Ferry Books reserves the right to terminate or suspend a member's membership at its discretion for any reason, including but not limited to breach of these Terms and Conditions, misuse of the Program, fraudulent activities, or actions contrary to the Program's interests.

7. AMENDMENTS TO TERMS AND CONDITIONS

Starry Ferry Books reserves the right to modify, suspend, or terminate the Program, including these Terms and Conditions, at its discretion. Members will be notified of any material changes to these Terms and Conditions.

8. GOVERNING LAW

These Terms and Conditions and the Program are governed by and construed in accordance with the laws of the United States without regard to conflict of laws principles. Any disputes shall be resolved in accordance with Section 9.

9. DISPUTE RESOLUTION

Any disputes arising under or in connection with these Terms and Conditions shall be subject to binding arbitration, except for intellectual property disputes. Class actions and jury trials are waived.
